The courts also play a big part in this.
A lower court isnt able to decide on a common law argument put forward as a defence, it would need to be moved up or refered to a higher court. They primarily deal with statute law and statutory obligations. Did you break one of these obligations? then this is where you are dealt with.

You also have judicial review and judicial merit.

If you wanted to argue that council tax is unlawful and is not applicable to yourself, you will be invited to a magistrates court. They cant adjudicate this matter on a common law principal (they may try) but if you know how the system works you would appeal. The case gets moved up a notch, each time a decision is made you could appeal to a higher court, eventually ending up at the supreme court and from there the house of lords.

I suspect you would win your argument, but this is how far they make you take it. In front of the lords of the house you will find that the constitution plays a very important and significant role, that common law is paramount and very much valid.

Most court staff at the lower end have very little understanding of common law and the constitution, if they did they would be working higher up. I wouldnt even enter a magistrates court, its a place of statutory obligations, i live under common law, that means the high court and a jury.

Allow me to sum this up for you:
You live in a so called democracy. There are M.Ps who are voted in as our representatives - whether we voted or not.
As our representatives they speak for us in parliament and, as such , have our Power of Attorney to do anything we can do legally. We can volunteer for statutes be emplaced.
They vote to have the statute put in place - therefore you have consented to it.

The tax man makes his claim against you for exactly the same reasons. Your MP volunteered you on your behalf to enter the tax contract when they voted to pay tax as they do every new sitting of parliament.
That's why when you fail to pay tax you are taken to a civil court and not a criminal one. Failure to pay tax is a breech of contract and you are up for review and enforcement of that verbal contract, not in a court of common law but in a civil court with an administrator and not a judge.
Come off the electoral roll. Inform the local MP he does not have your power of attorney. Inform the tax man of the same and see if he pursues you for tax. Better still, use article 61 of magna carta, which is how we have had our successes here.. You can always pay up under duress of circumstances.

A third lawful rebel here in Glastonbury, under magna carta 1215, has repelled the tax man using article 61 and also got a £1200 cheque given her to repay fines they'd already taken.
