New Kid On The Block

New Kid On The Block

Postby dunslavin » Sun Sep 13, 2009 10:08 pm

Hello All

As you can probably guess , i am a total novice here but think i am getting a good understanding of the whole 'freeman' theory and how to live and breathe it ! My problem is basically how to start the process . Im not sure i have jumped the gun but its too late now :giggle:
I lost my job last year and fell behind on all my payments so found myself 'deep in the s**t , i was put off the 'freeman' route partly cos i was lost in all the other sites BS , i linked up to FOTL purely by luck only 2 weeks ago and now it just feels like someone has switched the lights on , i know all the answers are here and i just have to do the research but this one thing is nagging me .
i just got a claim form from county courts for ££ and straight away have returned it along with a template i kinda like (below ). As this is my very first attempt and will be waiting anxoiusly to see their reply, i cant stop wondering if im on the right path or if i have jumped the gun - any advice would be much appreciated as i have another 8 or 9 similar accounts etc ready to scalp . Im kinda nervous about this but i feel i need to know the beginning procedure (if there is one) , but i already jumped now so ...we shall see .

Peace

Rob

To: THE CLERK OF THE COURTS

NORTHAMPTON COUNTY COURTS (CBCC)

NN1 2LH

9th September 2009

Dear Sir/Madam,
The enclosed paperwork (claim form) was delivered to the address at which I reside. It was addressed to the name MR ROBERT BYRNE. I have been led to believe that this signifies that the paperwork was addressed to a legal fiction known as a PERSON, which is, in point of fact, the name of some CORPORATION.

I would be most grateful if you would kindly confirm or deny my understanding in this respect.

Being a soverign human being, with a living soul, and consequently (as I understand it) under common law jurisdiction (I.E The Law of the Land, as opposed to Corporate Law, namely the Law of the Sea), I'm not entirely sure why I have received this paperwork, and I would be grateful for any clarification in this matter, because I have no wish to dishonor any valid and LAWFUL obligation on my part.

Article 45 of the Magna Carte 1215 states: "WE WILL APPOINT AS JUSTICES, CONSTABLES, SHERIFFS, OR BAILIFFS ONLY THOSE WHO KNOW THE LAW OF THE REALM AND WHO WISH TO OBSERVE IT WELL," and this cannot be repealed or voided in any way because it pre-dates all Parliaments, and, furthermore, the document says so itself in other Articles - And said document bears the Royal Seal.

In consequence of this, I assume you can confirm, in lay terms, the points I have risen.

According to Dunn & Bradstreet, there is a registered company known as NORTHAMPTON COUNTY COURTS. Since I am able to obtain a D&B Credit Report on said company, it seems reasonable to assume that, it is in business, actively trading, and offering services.

Please confirm that your’ good selves have no connection with said Trading Company, and that said paperwork was not an issuance from it.

Yours Sincerely,
Without ill-will, frivolity, or vexation,

Commonly called Robert: of the Byrne family.

Without prejudice, I.E my entire body of inalienable natural rights reserves.

Robert: Byrne

C/O
**** Avenue
Upton
WIRRAL

P.S ~ Please, use this name, EXACTLY AS PRINTED ABOVE, in any subsequent communications directed to my Self, the human being and living soul.

P.P.S ~ I would be most grateful if you would kindly confirm or deny my understanding in all respects within seven (7) days, as quite obviously I wish to clear up this matter as soon as possible.

Tell them there is no prospect of any pleading UNTIL they prove their claim....set out the terms, set out your questions requiring proof....push them .... and rubbish their opinion about what they consider to be prospects of success...(arrogant effers)

An admission that they have read your notice and decided to ignore it

The defendant shall file and serve a fully pleaded defence by 4pm 6th Otober 2009.

The defendant is a legal fiction and, as such, has no mind with which to think up a defence or hands with which to hold a pen. As a human being with a living soul and the sole authorised agent for the PERSON you could enter a plea on the defendant's behalf but I wouldn't because I'm pretty sure that would count as entering into a contract with the court. Better to serve them with a notice of estoppels by acquiescence since they've failed to respond in substance to your first notice? (DISCLAIMER: That's NOT legal/lawful advice, it just seems sensible and reasonable to me).

If no defence is filed the claimant may enter judgement by default

Ooh big scary words. Default? Isn't that what they're guilty of by dismissing your notice and refusing to respond in substance?

Welcome, by the way, Rob  I hope you have fun here. I certainly am.

Peace

J

Yes mate,

I have and am dealing with this court, what they are VERY, VERY VERY good at is tellling you is that your defence has no grounds. ( in other words you are talking sh*t --- ) I think that the clerks /managers are making the desicions also they will not prsent your notices to the JUDGE as they are scared of getting told off!!!! ( or plain villains).

So I have filed now an official complaint with regards to the fact that they are ignoring my letters... ( but not ignoring) what they are doing is refusing to hear/see your letters - what they are doing is making a judgement against you and then informing you of their decision.

You have to persist and stand by the fact that you are declaring your status to them and keep a good record of what you are doing...!!

IT IS NOTHING new, that the courts do not recognise the human being - remember well that this same system is the one that went off into the world and colonised - FAILING EVER to recognise any humans that they found. - except to call them natives/indians/blacks...(fictions)whatever.. but never people, never humans :peace:

Notice of Request for Clarification

Dear Sir/ Madam

This is a Notice and not a letter. Please read it thoroughly and carefully before responding. I am offering conditional agreement to pay any financial obligation I might lawfully owe, I believe this removes controversy.

Your letter dated 14 September is not substantial , it is totally irrelevant and non-responsive.
You totally ignored my earlier requests , hence , it is you that have in-fact defaulted .Your remark concerning my prospects of success is not very heart-warming and seems like you have assumed the outcome already.
.
There is no possibility of any pleading until there is proof of claim.

To further clarify this so as you cannot claim not to understand it is hereby demanded you provide on-point definitive responses to the following:

1.Proof of Claim that your actions are reasonable.

2.Full disclosure of the alleged debt. ( a lawful requirement of any contract).

3. Proof of Claim that any obligation on my part is to yourself by providing sight of the appropriate contract, or

4. Proof of Claim that any obligation on my part to persons for whom you act by providing sight of the appropriate contract.

5. Proof of Claim that any obligation on my part protects you from any future loss.

6. Proof of Claim that any obligation on my part is enforcement of a legal process on a Human Being under Common Law jurisdiction, who cannot possibly have such liability under said jurisdiction.

I request that you respond accordingly - in substance – within the next seven (7) days of the date of this letter. You will be deemed to have been served notice of my request and I will deem it served three (3) days from the date of this letter. This has been sent by recorded delivery.

Sincerely and without ill will, vexation or frivolity,

Robert: of the Byrne family
WITHOUT PREJUDICE, i.e. all Natural Inalienable Rights Reserved
Please address all future correspondence in the matter to a direct Human Self, namely Robert: of the Byrne family, as commonly called.

Robert; Byrne
