just to give you an update:

went round to the police
and surprise surprise it was shut

now I'm not picking an arguement with you
I'm just stating facts, regradless of what you may "know"
it is shut on a sunday
and it was shut at 4:45pm tonight
I'm just stating the facts as they are, may be it has something to do with it being a sub station
I don't know

I'll try again tomorrow, hopefully it won't be shut this time! :)

btw

when at the police station, with it being shut I decided to use the phone on the side of the building
first I was put through to strathclyde, then motherwell - I guess 40 miles from where I live is as good as any

I was told that if I wanted the information I requested then I would (probably) need to do so in writing

is this the case?
would I have to turn up at the police station with a letter requesting the information?
any help with what kind of letter this would be?
or do I not have to have a letter to request the information and they are just trying a fast one?

any help is greatly welcomed
urgently I guess as I have only until the 22nd

OK been to the police
but they refused to give me the information - all that was mentioned previously
said that I could only get it from the procurator fiscal
and that would take 3 to 4 weeks
and with my court case being less than a week away
creek and paddle spring to mind

any further information or help would be greatfully appreciated

I know asking for a reply is somewhat of an intrusion
but as I am totally new to this (I never even heard of it before) by a couple of days
a reply would be very welcome
even if it's just to tell me to sod off
just that my court date is just 5 days off I am at total panic stations
the police refused me the info
my lawyer wont reply to my letters - even just asking for a case number!

I was hoping that I could use some of the things I've read under Common Law as a base for my defence in the court
ie - if they don't have witness statements, if they don't have actuall footage or documented evidence etc.
assuming that the basics will be covered in court regardless of where they come from (if that makes sense?)
please help

When you are in court, tell the magistrate that you have not been supplied with the information you need by the police to make your defence. And fire the solicitor. Demand to see evidence that they were harmed; there should be a doctors report.

This is not legal advice as I am not a lawyer and is only what I might try after ending up in their jurisdiction as you have done. Maybe someone else here has a better solution to at least delay things a bit.
If you're scared of 'them' poisoning 'us' with some shit then maybe you haven't noticed the shit they are already poisoning us with.

I'm at my wits end at the moment I guess as the case gets nearer it's bound to happen

I read what you said with great interest, I think I found out today what they say that the lawyer has his priorities which mean I'm last on his list
although he did mention after seeing photos I took that their case against me is "begining" to fall apart - ie the claimant said he was punched in to a ditch... just there isnt a ditch anywhere in site

I do like the idea of dismissing my lawyer whilst at court just for the simple reason that he has been less than communicative with me, but I also think with me only just finding this site that I could be way out of my depth and I may have to trust my lawyer after all
he did advise me on the phone late today that going to the police to ask for the evidence etc would be detrimental for my case

I do think that banging my head against a brick wall until it's all over my be the best idea
then I can start being serious about becoming a freeman of the land

an update

just reading "the book" by veronica : of the chapman family
for the second time, I'm making pencil notes as I go along
whilst I'm in the lap of my solicitor I do feel that there are certain
aspects that I can use eg : "I want to entre as evidence"
then was planning on saying how I thought their witness was
1. bringing dishonour to the court
2. that they were trying to decieve the cout
3. that they were trying to defraud the court
4. that they were a liar, under oath
5. that I was attacked in my car, that I was blocked from exiting my car, that I was attacked outside my car, that I defended myself
6. what law have I broken? I haven't broken any law I just defended myself
7. I'll ask that the case is dismissed & I am given compensation
was also planning on keeping an eye open for orders

one last question before I'm through:

by my attending an "intermediate diet" where "tacitly" I accepted my "legal fiction person"
and was thus in Court Proceedings

can I opt out?

As I was unaware of any proceedings - common law or otherwise - do I have the option to step out of the "court" (or "Bar")
and make the statement "I am here making a Special Appearance in order to Establish Jurisdiction..."
I was thinking that I would probably have to lose my lawyer at this point? (! lol)
but is it a possibility or would I just be denied because I was already in acceptance of their method of dealing with me as a
legal fiction person (if that makes sense)

(I think it may have already been answered but in a different context)

well the case is over with
I asked if it was a court de jure or court de fato
then I asked it it was a court of justice or a court of arbritation
I was told it was a court of jurisdiction but there was no jury

my lawyer couldn't make it so he sent his dad
his dad said his son would have fought it
I had the charge of breach of the peace dropped
I had the dangerous driving dropped - I was accused of attempted murder! dropped
but I had to agree to aggrevated assualt and a £315 fine

I could see at every moment how things would have gone if I had gone with common law
I think I would have won
their report to the police was after five days
three days after I went to the police to complain about the assault!
there was no other witness apart from his wife, so there was no independant witness to the alleged assault
there was no doctor's report of his injuries
he claimed "his hand hit my car" - accepting assault?
unfortunately my attempts to get the only independant witness failed so I was lost without him
I'm supposed to be happy with a police record and a £315 fine but somehow I'm not
I did try and say something twice in court but was told that I didn't have to bother
I must admit that when the judge said they were her roads and it wasn't single file when the actual pictures show it is single file
then I guess I got away lucky, she did appear to be a real bitch
