That made me chuckle....fair enough....it probably is a police incident...but it could have been a brawl outside a pub....you looked at my girl friend....no i didn't etc etc

just to clarify

this was a "road rage" incident between myself and another motorist
there was an independant witness, but unfortunately the police didn't bother to take their name & details
there was a passenger in his car, his wife, but she can't be considered an "independent witness"
she phoned the police claiming that I was car-jacking them

I was sat in my car when he kicked my car door
he blocked me from exiting my car
when I got out he again attacked me
I then attacked him hitting his shoulder
this kind of stop him as he was up against someone who wasn't prepared to just let him attack me without defending myself
there was ten minutes of screaming and shouting at each other
then this witness said it would be better if I just left so I did
passing the police on my way
the police have said that they had to swerve to avoid me
but I answered how could that be when I was on my side of the road?

looks like you was closer to the mark than i was lol..

dnb..

i would still be going and collecting all the details to provide myself with the ability to defend myself civilly

as for monday stations are 24/7 mate..even village small stations(not many about now if any) still have to provide a 24 hour contact.

Then the next question is: Who was the assailant?

And then, of course, by pleading "not guilty", jurisdiction has been consented to.

NEVER PLEAD, if any Statute is mentioned in the charge.

there was an "intermediate diet"
where I pleaded not guilty and self defence
less than five minutes appearance before the magistrate
(no jury was present)
I just answered yes to my name, the lawyer did the rest
the case was then given the date of the 23rd of june

I'm being classed as the assailant
ie the one who attacked the other driver
but like I said this is bogus
he jumped out of his car, kicked my car door, blocked me from exiting my car, then again attacked me, then I attacked him in self defence
(he's even said I was "of my face on something" - which is BS as I'm teetotal and they can have a blood sample anytime they want)

so you're saying I should never have entered a plea in the first place?

is it too late now that my "lawyer" has entered in my not guilty plea to now say the above?
- by the way this was done on my behalf by a lawyer - who was standing in as my defence lawyer couldn't make it that day

Sorry, but there is absolutely nothing we can do if you are using a Lawyer. A Lawyer will not take your advice nor ours.

By employing a Lawyer you are agreeing:

1. To be considered a ward of the Court, and

2. To the jurisdiction of the Court.

You can only refuse to plea if you are not employing a Lawyer.

This is explained in the FAQ Section.

would it be possible to drop the lawyer at this point and deal with things myself?

I'm just reading through the FAQ's so many thanks

I'll still go to the police for all the relevant information mentioned
my lawyer did seem to think that it was bogus, so I do hope that my having gone to a lawyer will not be to detrimental
obviously when it happend the first thing I thought of was to go to a lawyer
but then I had no idea whatsoever about this site and what I'm capable of doing
