Council tax help

Hello, I posted this up on TPUC and had some help on jurisdiction about the courts but not much else help regarding handeling the council. So I wondered if people could give me some constructive information. fistly I've refused to pay council tax since 2004 to date with an intrim period where I was cliaming council tax benifit, I've managed to stave them off up until now where I've recieved a letter stating they are applying to the courts for my commital to prison so I've written them a few letters, I wondered If anyone can help, Below are the letters written by me and the responses.

This first letter is the same for every year since 2004.

Without prejudice:
In the matter of your claim for council tax arrears for the period of 01/04/2009 to 31/03/2010 for the amount of £708.28 - I can advise that I accept your offer to pay council tax conditional upon the following:-

1. That you can demonstrate that there is a contract between the west Oxfordshire district council and me, me of the family them (the man) and not MR CAPITOL(the person and a corporation).

2. That the West Oxfordshire District Council have given full disclosure ( as required by common law) the services being offered and that these have been accepted by me for the value so stated.

3. That you can demonstrate manifestation of intent by way of my signature on a contract between us.

4. That the terms and conditions of any contract are lawful (in common law - not statute law).

5.That council tax is lawful.

I would further advise that the revenues and benefits service of West Oxfordshire District Council should be fully aware of the status of West Oxfordshire Magistrates court as being a branch of the “ministry of justice” which is a registered corporation - and as such conducts its business under Admiralty jurisdiction - whose rulings are invalid on dry land without the consent of BOTH parties to the hearing and that I specifically do not give my consent to these proceedings under this jurisdiction.

Dear Mr XONE

With regard to your previous e mail and the points you raise, I will deal with each one in turn.

1. You are disputing how we are addressing you. This matter has not been raised by you in the previous 6 years that you have been resident at your property. Please supply official evidence of your name for example your birth certificate,driving licence or passport.

2. The services provided by West Oxfordshire District Council are disclosed in a booklet accompanying your annual Council Tax bill issued in March each year. The services are paid for by the Council for which Council Tax is collected as a contribution towards these costs.

3. Legislation does not require there to be a contract see item 4.

4. No contract is necessary as even a squatter can be liable for Council Tax.

5. The Local Government Finance Act 1992 makes Council Tax lawful.

6. There is no such thing as the West Oxfordshire Magistrates Court. We come under the North Oxfordshire Magitrates Court services. Any issues regarding their proceedings need to be taken up with the court.

Thank you for your response, I shall querey each point in turn.

1. Please see enclosed in the attachments of this email a Statutory Declaration of True Name. This is a legal document in law and as such proves who I am. As to why I haven't queried this in the past 6 years is of no consequence and as such shouldn't be regarded in this matter. After viewing the document can you demonstrate that there is a contract between west oxfordshire district council and me, me of the family them (the man) and not MR CAPITOL (the person and a corporation).

2. The WODC "booklet" only gives a brief and vauge outline of what services are provided by WODC I'd like to see a full breakdown of where my council tax contribution actually goes because I'm 100% sure that not all of it goes on street lighting, refuse collection and the police. Also You've avoided the second point I raised with this subject and thats my consideration for the services being offered and that these has been accepted by me for the value so stated. Please provide me with this information.

3. Legislation is an act of parliment and therefore can only be given the force of law under the consent of the governed, see Magana carta 1215, In particular chapters 14, 29 and 61. Sadly chapter 14 has been repealed by the Criminal Law Act of 1967, but since our oaths of allegiance incorporate the constitutional laws, it is perjury to attempt to repeal them. It was a return to tyranny then and so it is now. This means what we are faced with is a fabian government and it's implementation by violent and illegal means of the council tax act of 1992, which is contrary to the Great Charter and the Bill of Rights. This subjects anyone questioning or refusing to pay the illegitimate and fraudulent additions of a tax demand to imprisonment through a liability order, effectively preventing any questioning or refusal to pay the tax for items that are not part of the service charge. By this I mean money gianed from tax collection paying for civil servants pensions, Christmas parties, etc. Hence, the request for a full breakdown of where our money goes (SEE POINT 2). This is fraud by the Government and threatens the very nature of our democratic rights and freedoms. Plus, If there is no contract then where is the Liability?

4. See point 3.

5. You quoted "The Local Government Finance Act 1992 makes Council Tax lawful". Incorrect, This Government act makes it Legal and not Lawful, I reffer you again to point 3.

6. Apologies, I made a mistake with which court service we come under, however, please see your attachments, I have included a copy of a print out from Dun and Bradstreet, the print out clearly states that the Ministry of justice is registered as a company, trading as Asylum imigratin tribunal, a Magistrates court and a public trustee office. as I'm sure you're aware the ministry of justice covers all Magistrates courts in the UK and thus it covers the North Oxfordshire "branch" and if any issues arising from this are taken up with any Magistrates court in the UK a Notice of Public Declaration of Non-Jurisdiction - Denial of Service will be issued.

I'd like to bring to your attention that you've not clearly answered any of my orignal questions and in not answering them properly you've raised more points that need to be answered. Please respond within seven (7) days from the date of this letter/email under penalty of perjury, under full commercial liability and under a sworn affidavit of truth, The email you've used as a reply is not a sworn affidavit of truth but merley an excuse not to answer any of the questions I've asked, an example of an avidavit of truth is included in the attachments as my SDTN. And on Friday I recieved a postal letter with a new bill for council tax for this year asking me to pay by installments.

Any information about the way to handel this would be really appreciated.

1. Attend the hearings in person. :phew:

2. You make great points, great letters, - simplify it though - as there is plenty of time to look for an answer to each point before jumping to the next, you have alot of ammo.

for many of us here it's time to attend the hearings in person,hold under fire after 6 years maybe it's time to follow through?

I did hear about the Wirrell council, thats what my first letter is based on. I've not attended any of the liability hearings, my own fault and as yet there is no hearing for my commital to prision, I don;t fancy attending that as I may well not come out again! But afater 6 years maybe your right.

Do you have any tips regarding handling the next move by the council?

You seem to be doing quite well on you own!

my 2p worth, as Im sure you know:

Please supply official evidence of your name for example your birth certificate,driving licence or passport.

If they mean your human name, no official evidence can be given, since you may or may not have been present at the time your parents named you and thats hearsay.
If they mean YOUR STRAWMAN name, they already have it, and thats not you...

Well done!

Re point 5 (above) claiming that this is a lawful when it is a statute -> is that professional misconduct tantamount to fraud?

i posted the same letter, this is the response i got...

Dear Mr Welsh,

Thank you for your email dated 17th May 2010, in which you requested
information relating to the lawfulness of Council Tax. The letter you
have forwarded is an amended version of a letter which, insofar as I am
aware, first appeared on the website www.nocounciltax.com

Whilst the internet is a useful medium for obtaining and exchanging
information on a variety of subjects it should not be relied upon as an
authority on the lawfulness of Council Tax or any other duty placed on
individuals by Acts of Parliament.

The contents of your letter would, generously, be described as nonsense
and therefore I do not intend to comment on them in any detail. If you
would like to determine the legality of Council Tax then I would suggest
that you take your email to a qualified solicitor or barrister and ask
for their legal opinion of your position and the legality of Council
Tax.

Your Council Tax remains payable as set out in the notices which have
been sent to you.

There is a warrant for your arrest in force in regard to the committal
debt. This has been through the Court process and you attended the
hearing and made your case to the Magistrates. There is a suspended
prison sentence in force where you are not complying with the terms of
that suspension. The result of your non-payment is likely to be your
immediate imprisonment.

I would suggest you consider making payment to avoid this.
