Order to pay PCN after Freeman defence and DVLA

Hi
I wonder if anyone can help please. I got a PCN thro/speeding and did 2 ok freeman defences at Tameside Magistrates Crt ie. avoided name,refused to contract, persued judge's oath etc - in end they've sent an order thro (6 pts/£300!). I've replied `as judge not on oath, I'm not lawfully obliged to accept it'. Also, got DVLA asking for licence for points to go on.I sent them a letter explaining that the judge was not on his oath and as such order not valid. Also suggested I can issue a commercial lien if they continue.

I'm expecting the Courts to continue with the order - possibly farming out the order/debt/fine to an `agency' and also worry about the DVLA cancelling my licence.And knock on for car insurance. (Hey, I know a true freeman would plough on and set up with no licence/insurance etc etc but I'm a novice,running out of time).

Any help realy really appreciated. Have read Mary: Croft (brilliant) and also Veronica:Chapman's excellent book but have not used blogs before and am struggling with direction.

Well I certainly wouldn't pay the fine, the points on your fictional licence don't really matter, who cares? They are your strawman's points not yours. You dont have to tell your insurance anyway, I didn't.

As with the fine I'd just keep refusing for cause any documents they send.

Thanks mate for reply,appreciated. Don't want to sound precious but I'm not ready to jump off fully in to Freeman land (as much as I'd like to) and walk away from all contracts, and I use my car/licence every day as a rep. I just fret that they will escalate and pass the fine/debt on to ill trained ape and then it could start getting proper heavy.Also, as I understand it, (and I know I mean in legalese land), I would have to declare any points they put on (if it comes to that). And/or they could cancel my licence/DVLA.
I'd love to say fuck em and walk away and all that but as well as (Fu*%ing) work I'm the only driver and we have to go to kids hospital often.
I need to look up `refusing for cause'!!

Hi Holmfirthbobble,

There is remedy for this and I believe you can be successful however you must be aware it takes time and effort. I would consider reading the following:

Pay particular attention to the latter part but do read all of it.

2>Read the bill of rights, attention to article 12.

The above is heavy reading and your issue can be tackled without it but it will provide further insight.

Essentially the crux of the whole PCN is issue is that we are led to believe they are legitimate fines when infact if they were a fine they would be in breach of article 12 of the bill of rights. Instead they seem to be contractual offers and thus require your consent.

The problem is you already have a court order against you. You may want to consider the following options:

1>Refuse for cause the court order.
2>Put an application into the court to set aside the courts decision and strike out the claim using the grounds you have already learnt and those discussed in the above information.

Please do not take what I say as the only or the definitive facts of the matter I and anyone else on this forum may be wrong!. ... research yourself and ask questions,

Treeman, ye of dextrous with keyboard by the looks of it! I'd just found the Bill of Rights 1689 (google) before returning here to let Mr Frodo know I wasn't a complete muppet! Thanks fellow CleckHuddersfaxian. I'll cut and paste em all to a word doc for quick reference.
If ever there's a local meet I'd love to come along...
