in the US, there may be no equivalent to our Land Registry (or there
may be ... still trying to find out).
All foreclosure claims in the UK are based on "Is the
Bank/Building Society's name on the Charge at the Land Registry
... if so, then they can have what they want".
The fly-in-the-ointment here is that the Land Registry accepted the
Charge Registration when the Bank/Building Society had no right to
make it ... known as the "Registration Gap argument" ...
which is under Appeal in 5 Cases at the moment.
It looks as though the US might be leading the way here ... although
we are right behind ...
